CITY COUNCIL MEETING

June 16, 2008

PRESENT:
Mayor Todd Eberle; Council Members Loretta Ertel, Sandra Leonard, Stuart Miles, Alan Simon, Sandra Tucci, Lee Zimmerman; City Attorney Grover Potts; City Administrator Ann Simms; Police Lt. Dennis Wine; Recording Secretary Ann Melton; Court Reporter Bruce Handy.
Mayor Eberle called the meeting to order at 7:00 p.m.
APPROVAL OF MINUTES:
Council Member Alan Simon moved approval of the minutes of the regular City Council Meeting of May19, 2008; Council Member Sandra Leonard seconded; passed unanimously.
BUDGET MESSAGE:
Mayor Eberle noted that the agenda includes second readings for the Operations Budget Ordinance, the Municipal Road Aid Fund Ordinance, and the Ad Valorem Tax Rate Ordinance. He also noted that the Kentucky General Assembly will be addressing Pension Reform Legislation in special session next week and encouraged Council Members and citizens to contact our legislators to give views on the proposals. The City's grant request with the Kentuckiana Regional Planning and Development Agency (KIPDA) to conduct a comprehensive transportation assessment and plan for Prospect will be considered by KIPDA at their June 23 rd meeting. Plans for the City's 4 th of July Celebration are going well. A new food vendor and free carriage rides will be added this year.
SPECIAL ORDER:
Mayor Eberle opened the SECOND PUBLIC HEARING ON SETTING THE AD VALORUM TAX RATE FOR THE CITY OF PROSPECT. The Mayor stated the tax rate of 21.25 cents per $100 of assessed property valuation would remain the same as in the past several years. There was no offer of testimony from citizens or the general public at the public hearing. The Mayor then declared the second public hearing on setting the ad valorem tax rate closed.
POLICE REPORT:
Lt. Dennis Wine presented the monthly police report. This month, the Kentucky State Police sponsored a "Click it or Ticket" campaign regarding seatbelt use. Prospect cited one person for a seatbelt violation during the period. The Department received several misdemeanor theft-from-vehicles reports in the vicinity of Montero Drive and the area has recently formed a block watch in response.
COMMENTS FROM CITIZENS AND GUESTS:
A city resident expressed concerns regarding a garden at Rockingham and Indian Springs Court which has a fence surrounding it which may violate city ordinances or neighborhood deed restrictions on fences and the location of vegetable gardens. The Council agreed to look into the issue and make suggestions as to how this and similar situations might be handled.
UNFINISHED BUSINESS:
Council Member Sandy Tucci gave SECOND READING, ORDINANCE 488, SERIES 2008: AN ORDINANCE ESTABLISHING A BUDGET FOR THE GENERAL FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 2008 AND ENDING JUNE 30, 2009. Seconded by Council Member Simon; passed unanimously by a 6-0 vote.
Council Member Alan Simon gave SECOND READING, ORDINANCE 489, SERIES 2008: AN ORDINANCE ESTABLISHING A BUDGET FOR THE MUNICIPAL ROAD AID FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 2008 AND ENDING JUNE 30, 2009. Seconded by Council Member Tucci; passed unanimously by a 6-0 vote.
Council Member Sandy Tucci gave SECOND READING, ORDINANCE 490, SERIES 2008: AN ORDINANCE LEVYING AN AD VALOREM TAX RATE FOR THE CITY OF PROSPECT. Seconded by Council Member Alan Simon; passed unanimously by a 6-0 vote.
EXECUTIVE SESSION:
Mayor Eberle suggested a need for an executive session to discuss the possible purchase of real estate by the city. Council Member Zimmerman made a motion to move to executive session; Council Member Ertel seconded; passed unanimously. The Council went into Executive Session at 7:45 p.m.
ADJOURNMENT:
Upon return from executive session it was announced that no specific action had been taken which needed to be confirmed or adopted by the Council. Council Member Sandra Tucci moved to adjourn; Council Member Loretta Ertel seconded; passed unanimously.
Mayor Eberle declared the meeting adjourned at 8:14 p.m.
