Mayor Falk called the meeting to order at 7:30 p.m.

APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of March 15, 1999; Council Member Simon seconded; passed unanimously.

MAYOR’S BUDGET MESSAGE FOR FISCAL YEAR 1999-2000
Mayor Falk presented his budget with a multimedia presentation reporting the City to be in good financial shape with an excess for 98-99 of $948,000.00. Highlights of budget included: New Library – Phase I, $365,000, Full-time Maintenance Person, $10,000, Computer Network, $10,000, Tree Maintenance $7,500, Patrolmen Salary Step System, $16,000, COPS Increase $1,000, Solid Waste Increase $35,000, Residential Auto Identification 000, Increase Community Celebrations $8,000, Infrastructure Improvements $10,000.

Mayor Falk introduced Jim Milliman as Interim City Attorney, who will serve at no charge to the City until such time as a permanent City Attorney can be appointed and sworn in. Former City Attorney John Evans has resigned his position as of this date. The Mayor thanked Mr. Milliman for his continuing contribution to the City, which, he said, has extended for as long as he has been involved with Prospect.

Mayor Falk then introduced Patrick Stewart, Boy Scout from Troop 317 at Christ Church, attending the Council meeting for the purpose of working on a merit badge.

Officer Harold Proffitt was then introduced as the City’s newest officer. Officer Proffitt has finished his training period and will be regularly seen throughout the City.

OPENING OF BIDS – SOLID WASTE COLLECTION CONTRACT
The City of Prospect received three bids. These were from Rumpke, Waste Management and BFI. The contract was awarded to Rumpke. The following is comparison information:

PUBLIC HEARINGS
FIRST PUBLIC HEARING: USE OF MONEY RECEIVED BY PROSPECT FROM LOCAL GOVERNMENT ECONOMIC ASSISTANCE (COAL AND MINERAL TAX) FUND (Approximately $135 Fiscal Year 99-2000). Mayor Falk stated this would be used for general expenses and opened the hearing for public comment. There being no public comment, Mayor Falk closed the public hearing.

FIRST PUBLIC HEARING: USE OF MONEY RECEIVED BY PROSPECT FROM STATE MUNICIPAL ROAD AID FUNDS (Approximately $44,000 Fiscal year 99-2000). Mayor Falk stated that this would be used for some snow removal and also possibly heating elements for entrances to subdivisions for snow and ice removal. Hearing was opened for public comment. There being no public comment, Mayor Falk closed the public hearing.

FIRST PUBLIC HEARING: SETTING THE ADVALORUM TAX RATE FOR THE CITY OF PROSPECT AT 21.25 CENTS PER $100 ASSESSED VALUATION. Mayor Falk opened the hearing for public comment. There being no public comment, Mayor Falk closed the public hearing.

Council Member Milliman gave FIRST READING OF ORDINANCE NO. 394, SERIES 1999: AN ORDINANCE ESTABLISHING A BUDGET FOR THE GENERAL FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 1999 AND ENDING JUNE 30, 2000.

Council Member Simon gave FIRST READING TO ORDINANCE NO. 395, SERIES 1999: AN ORDINANCE ESTABLISHING A BUDGET FOR THE STATE MUNICIPAL ROAD AID FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 1999 AND ENDING JUNE 30, 2000.

Council Member Zimmerman stated he and Council Member Tucci, as members of the Budget Committee, had met with the Mayor and City Administrator Ann Simms for a number of hours to go over the budget in great detail. He said several suggestions were recommended by Council Member Tucci and himself and these were incorporated into the budget by the Mayor. He added he believed the budget to be a solid one which merited passage.

COMMENTS FROM RESIDENTS
There was a lengthy discussion of the potential new City Library with questions from residents concerning cost estimates, feasibility, design, staffing and maintenance costs. Mayor Falk stated that we were in the beginning process and more information will be available in the near future.

Joe Kehlbeck and Judi Ciliberti presented petitions from residents of Cedar Bluff Court and Spruce Hill Road, Oldham County section, which were signed by 100 percent of the residents asking to be annexed by the City of Prospect. Kehlbeck praised Mrs. Ciliberti and others who have done a great deal of work on this project.

Council Member Milliman gave FIRST READING: ORDINANCE NO. 392, SERIES 1999: AN ORDINANCE PROPOSING TO ANNEX TO THE CITY OF PROSPECT A CERTAIN TRACT OF LAND ADJACENT AND LYING TO THE NORTH AND EAST OF THE PRESENT BOUNDARY LINE IN THE ESTATES OF HUNTING CREEK.

Joe Dunn, owner of the Harrods Landing Yacht Club and Marina, was present to request a special variance for a sign relating to sale of boat slips. Mayor Falk stated that there was nothing in the sign ordinance to allow Mr. Dunn the kind of sign he wants and that it would mean having to amend the sign ordinance. After discussion, it was decided that the City would work with Mr. Dunn to find a compromise. 

POLICE REPORT
Chief Day presented the monthly Police Report stating that he hopes to begin the process of hiring two more officers very soon, bringing the total number for the department to nine. Col. Day also stated that the officers have had to destroy several raccoons with distemper lately. He would like to warn residents that if they should see a raccoon or any wild animal acting strange or being too friendly, to please call and do not attempt to go near them.

NEW BUSINESS
Council Member Smith gave FIRST READING ORDINANCE NO. 393, SERIES 1999: AN ORDINANCE REGULATING THE DISTANCE BETWEEN PACKAGE LIQUOR SALES IN THE CITY OF PROSPECT.

Tom Springer from Presnell Corp. presented the Council with an extensive draft of AN ORDINANCE TO GOVERN THE USE AND TYPE OF OUTDOOR LIGHTING FOR THE CITY OF PROSPECT, KENTUCKY. This is a study for commercial lighting and what would be presentable for the City. He would like a committee formed to go out at night and look at all possibilities.
