MINUTES CITY
COUNCIL MEETING
August 16, 1999

PRESENT
Mayor Lonnie Falk; Council Members Raymond Burse; Nan Milliman; Harold Smith; Alan Simon; Lee Zimmerman; City Attorney Judi Ciliberti; City Administrator Ann Simms; Police Chief Mike Day; City Secretary Anne Brunner.

Mayor Falk. called the meeting to order at 7:30 P.M.

APPROVAL OF MINUTES
Council  Member Simon moved approval of minutes of the regular City Council Meeting of July 19, 1999; Council Member Milliman seconded; passed unanimously.

COMMENTS FROM CITIZENS
Clyde Poynter of Autumn Hill Court commented on the condition of Autumn Hill Court stating that the final application of asphalt had never been applied to the road. Mr. Poynter also brought to the Council’s attention a possible drainage problem to some residents of Autumn Hill from the new home being constructed on Lot # 18 Fairway View Court.

Mayor Falk introduced Lt. Commander Burt Deshayes and Petty Officer David Kiper of the Coast Guard who were present to discuss the progress of the boat owners to comply with state and federal laws concerning the dumping of sewage into the marina. Both officers are satisfied with the progress being made. They estimate 90 percent of the boats will be in compliance by this weekend. Bill Bradley, boat owner at the marina, asked for the Council to vote on Ordinance # 398, Series 1999: AN ORDINANCE TO PROTECT THE ENVIRONMENT BY REQUIRING CERTAIN MEASURES TO PROHIBIT THE DUMPING OF SEWAGE INTO BODIES OF WATER LOCATED IN THE CITY OF PROSPECT (THE PROSPECT CLEAN WATER ORDINANCE. Council Member Simon moved the ordinance be removed from the table, Council Member Milliman seconded. The motion to remove the Ordinance from the table passed 3-2. Discussion followed. Council Member Burse moved the Ordinance be tabled until the November, 1999, meeting; Council member Smith seconded; passed unanimously.

POLICE REPORT
Police Chief Mike Day presented the monthly report. Chief Day reported that the City had purchased two new cars, one presently being outfitted with equipment, the other in the parking lot. Chief Day invited all to look at the new car graphics, which will gradually be introduced into the City replacing the old black and white model. The new cars are white with blue stripes and less expensive since they do not have to be painted.

Chief Day also introduced the City’s newest police officers: John Tucker, who completed his training today, and Mark Ratterman, who is still in the process of training.

NEW BUSINESS
Council Member Milliman moved adoption of Resolution No. 3, Series 1999: A RESOLUTION COMMENDING RUSS CONGER FOR HIS CONTRIBUTION IN ESTABLISHING A CITY WEATHER PAGE ON THE PROSPECT WEB SITE. Council Members Simon, Burse, Smith, and Zimmerman seconded simultaneously; Passed unanimously.

Council Member Simon introduced Municipal Order No. 4, Series 1999: AN ORDER DIRECTING THE MAYOR TO ESTABLISH SCENIC EASEMENTS WITHIN THE CITY OF PROSPECT. Council Member Smith seconded: Passed unanimously.

Council Member Simon moved adjournment; Council Member Milliman seconded; passed unanimously. Mayor Falk declared the meeting adjourned at 8:17 p.m.
