CITY OF PROSPECT
CITY COUNCIL MEETING
January 11, 1999
 

PRESENT:
Mayor Lonnie Falk; Council Members Harold Smith, Sandra Tucci, Nan Milliman , Raymond Burse, Alan Simon, Lee Zimmerman; City Attorney John Evans; Police Chief Col. Day; City Administrator Ann Simms; Recording Secretary Phyllis A. O’Donnell.

Mayor Falk called the meeting to order at 7:30 p.m.

CERTIFICATION OF OATH OF OFFICE
Mayor Falk acknowledged signed and notarized copies of the Mayor’s and Council Members’ Oath of Office. These will be kept on file at Prospect City Hall and copies sent to the Secretary of State’s Office.

PRESENTATION OF THE BEACH CRAIGMYLE AWARD
Council Member Simon presented the 1999 Beach Craigmyle Award to Mayor Lawrence C. Falk thanking him for all his hard work as Council Member and Mayor in making the City of Prospect the best Fourth Class City in the state. Mayor Falk proudly accepted the award and thanked the Council.

APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of December 7, 1998, Council Member Simon seconded; passed unanimously.

COMMENTS FROM RESIDENTS:
Mr. Philip Grauman owner of the Woodlands had questions regarding permits for repair of hillside and for a directional sign. He also asked what was needed for him to erect a wind sculpture on the property. Mayor Falk suggested that he might use a street post for a directional sign and also utilize the sign at the entrance of the Landings. A permit would be needed to erect a wind sculpture to be approved by the City. Repairs to the hillside are still under consideration.

POLICE REPORT
Chief Day presented the December 1998 police report. Chief Day stated that on Saturday, Jan. 9, 1999, five applicants for took the written exam for position of officer and that by Jan. 20 oral interviews should be completed so that two of the best applicants can be sent to the Mayor for the final decision. Chief Day also announced that Officer Cammack had been granted permission for take home police car privileges based on his good performance on the job and good attitude.

Council Member Simon complimented Chief Day on the good job he was doing and said he had received good feedback concerning the Police Department.

There was no unfinished business.

NEW BUSINESS
Council Member Smith gave first reading to ORDINANCE NO. 384, SERIES 1999: AN ORDINANCE AMENDING THE BUDGET FOR THE GENERAL FUND FOR THE FISCAL YEAR JULY 1, 1997 THROUGH JUNE 30, 1998. Seconded by Council Member Simon; passed unanimously on a roll call vote 6-0. This was introduced on an emergency basis and was passed on first reading because of time restrictions.

No Council Member wished to introduce ORDINANCE NO. 385, SERIES 1999: AN ORDINANCE AMENDING 157.27 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT RELATING TO REAL ESTATE SIGNS IN RESIDENTIAL AREAS; Philip Grauman opened the discussion and was offered suggestions by the Mayor and Council to locate a direction sign to his property.

Council Member Simon gave first reading to ORDINANCE NO. 386, SERIES 1999; AN ORDINANCE AMENDING THE BUDGET FOR THE SEWER TREATMENT PLANT FUND FOR THE FISCAL YEAR JULY 1, 1997 THROUGH JUNE 30, 1998. Seconded by Council Member Milliman; passed unanimously on a roll call vote 6-0. This was introduced on an emergency basis and was passed on first reading because of time restrictions.

Council Member Burse gave first reading to ORDINANCE NO. 387, SERIES 1999: AN ORDINANCE AMENDING THE BUDGET FOR THE STATE MUNICIPAL ROAD AID FUND FOR THE FISCAL YEAR July1, 1997 through June 30, 1998. Seconded by Council Member Simon; passed unanimously on a roll call vote 6-0. This was introduced on an emergency basis and was passed on first reading because of time restrictions.

Council Member Burse gave first reading to ORDINANCE NO. 388, SERIES 1999; AN ORDINANCE AMENDING SECTION 92.03 OF THE CODE OF ORDINANCES OF THE CITYOF PROSPECT RELATING TO DECLARED NUISIANCES. Council Member Milliman seconded; passed unanimously on a roll call vote 6-0. The ordinance was introduced as an emergency given the continuing problems in certain areas with removing snow and ice from commercial parking lots.

EXECUTIVE SESSION
Council Member Smith moved the Council to meet in Executive Session for the purpose of litigation; seconded by Council Member Burse. The Council met in Executive session from 8:15 p.m. to 8:25 p.m.

ADJOURNMENT
Council Member Burse moved adjournment; Council Member Milliman seconded; passed unanimously. Mayor Falk declared the meeting adjourned at 8:27 p.m.
