CITY OF PROSPECT
CITY COUNCIL MEETING
NOVEMBER 17, 1997

PRESENT:
Mayor Lonnie Falk; Council Members Harold Smith, Nan Milliman, Raymond Burse, Alan Simon, Lee Zimmerman, Sandra Tucci; City Attorney John Evans; Police Chief Lewis Nugent; City Administrator Ann Simms; Recording Secretary Phyllis A. O’Donnell.

Mayor Falk called the meeting to order at 7:30 p.m.

Mayor Falk welcomed and introduced Boy Scouts from the Flying Eagles Patrol, Troop 30, working on their Citizenship Badge, along with their leaders, Bill Noble and Mike Powers. Scouts in attendance were Chris Barrett, Greg Noble, Jason Peters, Mark Powers, Chris Schulz and Ben Soto.

APPROVAL OF MINUTES
Council Member Smith moved approval of the minutes of the regular City Council Meeting of October 20, 1997; Council Member Burse seconded; passed unanimously.

COMMENTS FROM RESIDENTS
Paul Arena asked the Council to consider four issues of concern to the residents of The Meadows: what can be done about the increasing deer herds in the area, stating that they are damaging property and are a road hazard; a dip in road at the Meadows Entrance; a blocked drain culvert and providing a water supply on Charlock Island. Discussion of issues followed and Mayor Falk responded that there was nothing we could do about the deer, the dip in the road was responsibility of State Highway Dept., blocked drain will be checked periodically, and we will look into cost of water supply as well as for other areas of the City.

Mitch Bass of The Landings expressed concern about the increased speeding on U.S. 42 and asked if more radar could be set up. Chief Nugent will be looking at the situation and setting up patrols at peak times. Mayor Falk explained that a light at The Landings would be put up when the turning lane is installed which should be within the next two years. Mr. Bass also wanted to know about entrance landscaping and roads. Mayor Falk explained that the City could not spend tax money on private property for any reason. Mr. Bass will be looking into seeing what has to be done.

It was noted that the next meeting will be on Dec. 8 and that the January meeting will be Jan. 12th.

POLICE REPORT
Chief Nugent reported nothing remarkable for the month. He reiterated that he would be doing more traffic control on U.S. 42

NEW BUSINESS
Council Member Smith gave FIRST READING, ORDINANCE NO. 348, SERIES 1997: AN ORDINANCE AMENDING CITY OF PROSPECT ORDINANCE NO. 39, SERIES 1975, AS AMENDED BY ORDINANCE NO. 109, SERIES 1983, CODIFIED AS SECTION 72.02 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT REGULATING THE MANNER OF PARKING VEHICLES WITHIN THE CITY.

Council Member Milliman gave FIRST READING, ORDINANCE NO. 349, SERIES 1997: AN ORDINANCE AMENDING CITY OF PROSPECT ORDINANCE NO. 300, SERIES 1994 CODIFIED AS SECTION 10.99 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT PROVIDNG FOR A GENERAL PENALTY. This ordinance allows the City to fine anyone who disobeys City ordinances. Council Member Smith moved to amend the Ordinance to provide for a minimum penalty of not less than $25.00; Council Member Milliman seconded; passed unanimously.

Council Member Simon gave FIRST READING, ORDINANCE NO. 350, SERIES 1997: AN ORDINANCE AMENDING THE BUDGET FOR THE GENERAL FUND FOR THE FISCAL YEAR JULY 1, 1996 THROUGH JUNE 30, 1997. Mayor Falk reminded the Council the ordinance contained an emergency provision, requiring a two-thirds vote for passage on first reading. Passed unanimously on a roll call vote. Yes: Burse, Smith, Zimmerman, Milliman, Simon, Tucci; No: None

Council Member Smith gave FIRST READING, ORDINANCE NO. 351, SERIES 1997: AN ORDINANCE AMENDING THE BUDGET FOR THE STATE MUNICIPAL ROAD AID FUND FOR THE FISCAL YEAR JULY 1, 1996 THROUGH JUNE 30, 1997. Mayor Falk reminded the Council the ordinance contained an emergency provision, requiring a two-thirds vote for passage on first reading. Passed unanimously on a roll call vote. Yes: Burse, Smith, Zimmerman, Milliman, Simon, Tucci. No: None.

Council Member Zimmerman asked to be reminded of the events of “Light Up Prospect.” “Light Up Prospect” will take place on Friday, November 28, 1997, at 6:30
p.m. at the Cowley Open Space in Hunting Creek. Officer Larry Bush will be singing several holiday songs as will members of the First Baptist Church of Prospect choir. “Frosty the Snowman” will arrive on a Harrods Creek Fire Dept. truck and will be greeting residents and handing out candy.
